MINUTES

 

The St. Martin Parish School Board convened on this day at 5:00 P.M. at the Breaux Bridge Instructional Center with the following members present:  Messrs. James Blanchard, President, Steve Fuselier, Mark Hebert, Aaron Flegeance, Russel C. Foti, Robert E. Hollier, Richard Potier, Frederic Stelly, Floyd Knott and Ms. Wanda Babin.

 

ABSENT:  None

 

The meeting was called to order by James Blanchard, President.  Superintendent Lavergne opened the meeting with a prayer and the pledge of allegiance. 

 

Melisa Brasseaux, Bookkeeper, was announced as the Taylor and Sons May Employee of the Month.

Fifty-three retirees were recognized and honored. 

 

Ms. Lottie Beebe, Director of Human Resources, presented the 2012 Education Major Scholarships to Alex Thomassee, Cecilia Senior High and Kadijah Olivier , St. Martinville Senior High.

 

Board President, James Blanchard, pulled item #19, 2009 Bond Program.  Board Member, Floyd Knott, removed his items, #21 c (Timber Contract) & d (School Board properties).

 

On the motion of Mr. Flegeance, seconded by Mr. Stelly, and unanimously carried, the Board approved the following consent agenda items:       

 

a)       Minutes of the following meetings

·         Regular Meeting of May 2, 2012

·         Special Meeting of May 16, 2012

·         Finance Committee Meeting of May 16, 2012

 

b)       Finance Committee recommendations

 

·         Approval of Cecilia Junior High Gym Floor Project, total projected cost of $95,339 (Internal Capital Project) 

·         Approval of Cecilia Junior High Building B Roof Repair, 20 year standing seam retro-fit metal roof system with an estimated cost of $64,800 (Internal Capital Project)

·         Adoption of Framework for Budget Development - Medium Term Plan

g)       Teche News as official journal for the 2012-2013 school session

 

h)       Contribution to St. Martin Economic Development Authority (SMEDA) for 2012-2013 fiscal year in the amount of $29,055.60

i)         Authorized Board President and Superintendent to sign a petition in support of changing Courville Street to Dr. Martin Luther King Drive

 

j)         Approved the following resolution relative to Act 2 of the 2012 regular session:

 

WHEREAS, the Louisiana Legislature has passed and Governor Jindal has signed  into law Act 2 of the 2012 Regular Session of the Louisiana Legislature; and

WHEREAS, Art. 3, Sec. 15 of the Louisiana Constitution requires that all bills in the Legislature have a single object or purpose; and

WHEREAS, Act 2 of the 20-12 is forty-seven (47) pages long and addresses charter schools, school “scholarships”, and other objects or purposes in apparent violation of Art. 3, Sec. 15 of the Louisiana Constitution; and

WHEREAS, Art. 8, Sec. 13 of the Louisiana Constitution provides that state funding for public education shall be equitably allocated to the public school systems of the State for the benefit of public education; and

WHEREAS, Act 2 of 2012 calls for state funds to be used in support of students in private and parochial schools and calls for such allocations of public funds to be made directly to those non-public schools, all in apparent violation of Art. 8, Sec. 13 of the Louisiana Constitution; and

WHEREAS, the First Amendment of the United States Constitution and Art. 1, Sec. 8 of the Louisiana Constitution require the separation of church and state; and

WHEREAS, Act 2 of 2012 authorizes the expenditure of state funds in support of programs of education for students and parochial schools in apparent violation of the First Amendment of the United States Constitution and Art. 1, Sec. 8 of the Louisiana Constitution; and

WHEREAS, Act 2 of 2012 contains other provisions that are legally and/or constitutionally suspect; and

WHEREAS, the only way to get definitive interpretations of Act 2 of 2012 and the constitutionality and/or legality of its provisions is through litigation;

NOW, THEREFORE BE IT DULY RESOLVED, by the St. Martin Parish School

 

 Board in regular session duly convened that:

 

Section 1.  The St. Martin parish School Board authorizes the institution of litigation in federal and/or state court, either individually or as a member of a group of other public school systems with similar purpose, challenging the constitutionality and/or legality of Act 2 of the 2012 Regular Session of the Louisiana Legislature.

 

Section  2.  The School Board also authorizes the payment of all reasonable attorney’s fees and other costs incurred in such litigation is filed only by this School Board or on a pro rata basis is such litigation is filed in conjunction with other public school boards of the State.

 

Section  3.  The Superintendent is directed to come back to the Board with a recommendation of legal counsel to handle such litigation on behalf of the Board and to present to the board at that time for its consideration of a special counsel resolution employing such attorney for such purpose.

 

k)       Approved Student Insurance coverage and the renewal of the catastrophic insurance coverage in the amount of $92,000 effective 6/1/2012

 

l)         Approved to increase the extra pay stipends for non-exempt employees/ paraprofessionals to $7.30 per hour

 

m)      Approved the replacement of the coordinator position at JCEP, the St. Martin Parish Alternative Program, with a certified Assistant Principal.

 

On the motion of Mr. Hebert, seconded by Mr. Hollier and carried, the Board approved the change to Reduction in Staff Personnel Policy. (EXHIBIT A)

OPPOSED:     Mr. Fuselier, Mr. Potier

 

On the motion of Mr. Foti, seconded by Mr. Hollier and unanimously carried, the Board approved to suspend the rules and vote on a discussion item.

 

On the motion of Mr. Potier, seconded by Mr. Flegeance and unanimously carried, the Board created a position of Administrative Assistant and appointed Vickie Guidry a one year appointment to that position

               

The Board discussed the following topics:  reforms for bus routes (Knott); redistricting of School Board Districts (Fuselier); Worker’s Compensation (Hebert) and policies and procedures for new hires (Hebert).

 

On the motion of Mr. Hebert, seconded by Mr. Flegeance and unanimously carried, the Board went into Executive Session.

 

On the motion of Mr. Foti, seconded by Mr. Potier and unanimously carried, the Board came out of Executive Session.

 

On the motion of Mr. Flegeance, seconded by Mr. Fuselier and unanimously carried, the Board approved extending authority as discussed in Executive Session relative to the settlement of the matter entitled Claudia Prade v. St. Martin Parish School Board; OWC; Docket No.: 11-09648; District: 04.

               

On the motion of Mr. Hebert, seconded by Mr. Foti and unanimously carried, the Board approved the following Personnel items:
